The most direct primary-source documentation of the offence is the unsealed 1977 Los Angeles County grand jury testimony of the 13-year-old victim, Samantha Gailey (now Samantha Geimer), hosted by The Smoking Gun: The Smoking Gun — Roman Polanski Grand Jury Transcript
This is the verbatim transcript of the victim’s testimony before the grand jury that voted to indict Polanski. It describes, in her own words, how Polanski gave her champagne and part of a Quaalude during a photo session at Jack Nicholson’s Mulholland Drive home and then engaged in sexual acts with her despite her objections. It is graphic. The grand jury returned six charges on this basis.

Summary of the legal facts: On 10 March 1977, Polanski (then 43) was charged with six offences against the 13-year-old: unlawful sexual intercourse with a minor, rape by use of drugs, perversion (oral copulation), sodomy, a lewd and lascivious act upon a child under 14, and furnishing a controlled substance to a minor. Under a plea bargain the five most serious charges were dropped and he pleaded guilty to one count of unlawful sexual intercourse with a minor. He served 42 days of a 90-day court-ordered psychiatric evaluation, then fled the United States in February 1978, the day before sentencing, and has remained a fugitive since.
2003 Academy Awards — standing ovation (23 March 2003)
At the 75th Academy Awards, Polanski won Best Director for The Pianist . He was not present (he was, and remains, a fugitive); Harrison Ford accepted on his behalf. Because Polanski was absent, the documented ovation is recorded through the broadcast camera and press reporting, which captured the following individuals standing and/or applauding. The ovation itself was near-unanimous in the room and lasted roughly 30 seconds.

Following Polanski’s arrest in Zurich on 26 September 2009, the French writer-philosopher Bernard-Henri Lévy circulated a petition (promoted in the industry by Harvey Weinstein) demanding Polanski’s release. Worked with Polanski on Carnage (2011) and, in a later New York Times interview, defended her decision to work with him, calling him an extraordinary director while acknowledging the controversy.

Debra Winger publicly criticised the arrest while serving as president of the Zurich Film Festival jury at the time. The foreign ministers of France and Poland both urged Switzerland to release him, though the French government withdrew its public support on 30 September 2009, stating he was not “above the law.”

A separate petition was issued by the SACD (Société des Auteurs et Compositeurs Dramatiques). It eventually drew as many as 850 signatures.
